ARTICLE 1 : SCOPE OF APPLICATION
The content of http://www.sanrival.fr is the property of SAnrival. Any full or partial reproduction of this site is subject to our prior authorization. The present conditions of sale are concluded on the one hand by the company SAnrival with capital of 45734 euros whose registered office is in Montmagny, 15 rue Suzanne Valadon, registered in the Pontoise Trade and Companies Register under number 775 678 923 00050 and on the other hand, by any natural or legal person wishing to make a purchase via the website www.sanrival.fr referred to below as the buyer. The customer acknowledges having read the conditions of sale at the time of the order and expressly declares to accept them without reservation.
ARTICLE 2 : THE PRODUCTS
Each of the products offered for sale on our site is illustrated by a description and a photo.
The photographs in the catalogue are as accurate as possible but cannot ensure perfect similarity with the product offered, especially with regard to colours. The colors of the enamels, the colors of the decorations of the products presented can be different from the reality on your computer. The manual production of our products can lead to slight differences between the objects delivered and the objects shown in photos on the site.
All orders of customizable products of which the customer has ordered the visual, give rise to a presentation of a draft whose agreement of the customer is requested in order to start the realization. In the event that the customer has not ordered a visual, or that it is not offered, the customization will be carried out identical to what the customer has noted on his order, in particular with regard to capital letters, lowercase letters, deviations and accents. The information stated by the buyer (colour, texts, decoration, delivery address, etc.) at the time of the order acceptance is binding on the buyer: in the event of an error without correction by the customer, SAnrival cannot be held responsible for the nature of the product delivered.
On the contrary, in the extremely rare case of an error of color, text, decoration on our part, we will replace your article free of charge as soon as possible. The wrong article may be returned.
ARTICLE 3 : PRICE
Prices and shipping costs are indicated in Euros. The price is payable in full and in a single payment upon order. All orders are invoiced and payable in Euros only. For any delivery outside Metropolitan France, any customs charges or local taxes remain the responsibility of the recipient. Our offers of products and prices are valid as long as they are visible on the site, within the limit of available stocks. Cumulative discounts on certain products and promotional codes are not possible. SAnrival reserves the right to change its prices at any time, however it is understood that the price in the catalogue on the day of the order will be the only one applicable to the buyer.
In the event of unavailability of products after placing your order, we will notify you by email. Unless you want a replacement solution for an equivalent hardware, your unavailable order will be automatically cancelled and you will be refunded if your bank account has been debited.
ARTICLE 4 : PAYMENT
Payment shall be made under the conditions laid down in the order. The delivery costs are the responsibility of the buyer and are paid by him at the time of the order. Payments by credit card will be made through the secure E-transaction systems of Paypal or Payplug. For payments by cheque, the manufacture will be effective only on receipt of the latter. In case of double payment by credit card made by the customer in error, the amount deducted from the fixed costs of secure systems paypal or payplug will be refunded to him by check and sent with his order.
ARTICLE 5 : LIABILITY
SAnrival.fr makes every effort to ensure the confidentiality and security of data that could be entered or transmitted on its services, but could not nevertheless be held responsible for their deterioration, loss, or «hacking» that could occur despite all the precautions implemented. The user of the service, subscriber or not, therefore releases SAnrival.fr from any legal action and any claim for damages resulting from the loss and/or piracy of data.
ARTICLE 6 : RETRACTION
Purchasers, natural persons not professional, have a period of withdrawal of fourteen days from the delivery of their order to return the product to the seller for exchange or refund without penalty, with the exception of return costs. The product must be returned in its original packaging or in a suitable packaging for transport, in a condition allowing it to be put back on the market (it must not have been used, or have undergone any deterioration, however minimal, and be in a state of perfect cleanliness). The withdrawal period is not applicable to any product customized or made according to the customer’s specifications (in accordance with article L.121-20-2 of the French Consumer Code)
ARTICLE 7 : DELIVERY TIME
As a guide, the probable delivery date for metropolitan France is indicated on each description sheet of goods or services. We remind you that as an artisan SAnrival takes between 2 and 10 working days to complete your orders and will do its best to respect this date. Except in cases of force majeure, exceeding the time limit by more than 30 days may lead to the cancellation of the order by the buyer, if he makes the request by e-mail or by registered letter. SAnrival disclaims all liability in case of non-performance of the contract due to a case of force majeure (strike, flood, fire...).
ARTICLE 8 : DELIVERY
8.1 Delivery Methods SAnrival reserves the right to split shipments. Ordered products are delivered via the postal service (Tracked Letter or Colissimo, depending on the customer's choice and the nature of the order) to the delivery address provided by the buyer during the ordering process.
8.2 Transfer of Risk In accordance with current legislation, the risk of loss or damage to the goods is transferred to the buyer at the moment they, or a third party designated by them, take physical possession of the products.
8.3 Recommendations and Guarantees The seller offers various shipping methods:
Tracked Letter (Lettre Suivie): This economical shipping method allows for shipment tracking but does not include an insurance guarantee from the postal service in case of loss. In the event of a "Delivered" status contested by the buyer, the seller may require a sworn affidavit of non-receipt accompanied by a copy of a valid ID to open an internal investigation.
Colissimo: Only Colissimo shipments benefit from the guarantees and compensation provided by the postal service (La Poste). The seller recommends this shipping method to secure the delivery of your orders.
8.4 Inspection of Goods Upon delivery, the buyer is required to check the condition of the packaging and the goods. In the event of apparent damage related to transport, the buyer must file a reasoned claim with the postal services. Simultaneously, the buyer must inform SAnrival's customer service as soon as possible to allow for legal recourse against the carrier.
8.5 Incorrect or Incomplete Address It is the buyer's responsibility to verify the accuracy of the address provided at the time of order. In the event that the order is returned to SAnrival due to an "incorrect address" or "incomplete address" caused by the buyer:
If the buyer requests a refund: the refund will only cover the price of the items (initial shipping costs remain at the buyer's expense).
If the buyer requests re-shipment: they must pay the corresponding new shipping costs. No compensation or refund of shipping costs will be granted if the postal services were unable to deliver the package due to a lack of precision in the address provided by the customer.
ARTICLE 9 : GARANTIE
Products made of enamelled sheet metal are guaranteed for one year. SAnrival cannot be held responsible for any damage of any kind, whether voluntary or involuntary, following a shock that could result from the misuse of our products as well as its assembly (fixation). Any claim within the scope of the warranty must reach us with the proof of purchase mentioning the date of purchase as well as the part concerned. All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it can be returned to the seller who will take it back, exchange it or refund it. When purchasing, we only ask you for the necessary information (last name, first name, address, e-mail), and we prohibit any use of the data communicated on the website www.sanrival.fr for a purpose other than for a quality processing and a careful monitoring of your order. All the clauses contained in these general conditions of sale, as well as all the purchase and sale transactions referred to therein, will be subject to French law, the Courts will be those of the jurisdiction of Pontoise, Courts of the registered office of SAnrival S.A.S.
